Terms of Use
These are the house rules for les Archives. They are written to be read, not skimmed, and the short version is this: your photographs are yours, use the tool honestly, and we will do our best by you.
By creating an account or using les Archives (the Mac app, the iPhone app, the web tools on lesarchives.app and its subdomains, and the related services), you agree to these Terms and to our Privacy Policy. "We," "us," and "our" mean Les Archives, LLC, a New York limited liability company run by the team at by Trent Bailey. "You" means the person or business using the service. If you are using les Archives on behalf of a studio or company, you confirm you have the authority to bind it to these Terms.
1. Who can use les Archives
You must be at least 18 and able to enter a binding contract. les Archives is built for working photographers, their teams, their clients, and the publication editors they submit to. Keep your sign-in email accurate and do not share your account. You are responsible for what happens under it.
2. Your content stays yours
You own the photographs, captions, brand assets, and other material you put into les Archives ("Your Content"). We claim no ownership of any of it. You grant us only the limited license we need to run the service: to store, back up, display, resize, process, and transmit Your Content so that the product works, including sending it to the AI provider to write descriptions and to Instagram or Pinterest when you publish. This license ends when you delete the content or close your account, except for copies that linger briefly in backups.
You confirm that you have the rights to Your Content, including any permissions you need from clients, subjects, or other vendors, and that publishing it through les Archives does not break any agreement you have with them.
3. AI-generated content
les Archives uses an AI model (Anthropic's Claude) to write image descriptions, keywords, captions, and similar text based on Your Content and your brand notes. That output is yours to use, edit, or discard. It is a draft, not a promise. Review it before you publish it. We are not responsible for what the model gets wrong, and you are responsible for what you choose to post.
4. Connected accounts
When you connect Instagram or Pinterest, you authorize les Archives to publish the posts and pins you create and schedule, using the permissions you grant. You remain bound by Instagram's and Pinterest's own terms and community guidelines, and you are responsible for what you publish there. Nothing is published unless you create it and schedule or send it. You can disconnect either platform at any time in Settings or from within the platform itself. 5. Acceptable use
Use les Archives for its purpose: managing, describing, and publishing your own photography work. Do not:
- upload content you do not have the right to use, or content that is unlawful, defamatory, or infringing;
- use the service to spam, mislead, or harass anyone, or to publish content that violates Instagram's or Pinterest's rules;
- try to access another workspace's data, probe or overload our systems, or bypass security or plan limits;
- resell, sublicense, or share your license or API keys, or use the service to build a competing product;
- reverse engineer, decompile, or copy the software except where the law expressly allows it.
6. Licenses, plans, and payment
les Archives is licensed, not sold. Your license key lets you run the app on the number of devices your plan allows. Payments are processed by Lemon Squeezy as merchant of record, under their terms. Plan allowances (such as the number of images processed per month) are described at the point of purchase and may be adjusted with notice. Refunds are handled case by case; write to us and we will be reasonable.
If you bring your own Anthropic API key, you are responsible for that account and its charges.
7. Team members, clients, and editors
Workspace owners control who is invited into a workspace and what they can do. You are responsible for the people you invite. Client approval links and questionnaires are yours to send; make sure your clients know what they are being asked to review. Publication editors using the editor portal may view and request content that photographers have deliberately marked "on the record," and must honor the usage terms photographers set.
8. Our intellectual property
The les Archives software, name, wordmark, design, and documentation belong to Les Archives, LLC. "by Trent Bailey" and its marks belong to Trent Bailey. You may not use them without written permission, other than to describe that you use the product.
9. Feedback
If you send us ideas or suggestions, we may use them without obligation to you. We hope you will; most of the product came from photographers telling us what they needed.
10. Ending your account
You can stop using les Archives at any time and ask us to delete your data (see Data Deletion). We may suspend or terminate accounts that break these Terms, put other users at risk, or go unpaid, and we will tell you why unless the law prevents it. Sections that by their nature should survive (ownership, disclaimers, limitation of liability, governing law) do.
11. Disclaimers
les Archives is provided "as is" and "as available." We work hard to keep it reliable, but we do not promise that it will be uninterrupted, error-free, or that every scheduled post will publish on time, especially where Instagram, Pinterest, or another provider changes or fails. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Keep your own backups of your photographs. les Archives is a workflow tool, not an archive of record.
12. Limitation of liability
To the fullest extent permitted by law, Les Archives, LLC and its members, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or lost business, arising out of or related to the service, even if we were told such damages were possible. Our total liability for any claim will not exceed the amount you paid us in the twelve months before the claim arose, or one hundred US dollars, whichever is greater. Some jurisdictions do not allow these limits, in which case they apply to the extent permitted.
13. Indemnity
You agree to defend and hold us harmless from claims arising out of Your Content, your use of the service, or your breach of these Terms, including claims from clients, subjects, or platforms about content you published.
14. Governing law and disputes
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Suffolk County, New York, and you consent to their jurisdiction. Before filing anything, write to us at hi@lesarchives.app. Most problems can be sorted out with an email.
15. Changes
We may update these Terms as the product evolves. We will post the new version here with a new effective date and, for material changes, tell you in the app or by email. Continued use after the effective date means you accept the updated Terms.
16. Everything else
These Terms, with the Privacy Policy, are the whole agreement between us about les Archives. If any part is unenforceable, the rest stands. You may not assign these Terms without our consent; we may assign them to a successor of the business. Our failure to enforce a provision is not a waiver of it.
